TERMS AND CONDITIONS

1. General Use

  • Eligibility: Users must be at least 18 years old (or the legal age of majority in their jurisdiction) and have the capacity to enter into binding agreements. 
  • Restrictions: ​Prohibited uses include illegal activities, fraud, harassment, unauthorized scraping/data extraction, or commercial resale of products without permission.  
  • Account Requirement: Account registration is required for purchases. Guest checkout may be available for limited transactions. 
  • Violations: Violations may result in account suspension, termination, or legal action at Pratum Africa’s discretion. 

2. Product Information

  • Accuracy: Product descriptions are for informational purposes; minor variations (e.g., color, fabric) may occur.  
  • Disclaimers: Product images are illustrative. Inventory availability is not guaranteed until order confirmation.  
  • Pricing Errors: Pratum Africa reserves the right to cancel orders arising from pricing errors (e.g., incorrect website listings).  

3. Orders and Payments

  • Order Acceptance: Orders are confirmed via email only after payment validation.  
  • Payment Methods: Accepted methods include M-Pesa, Visa/Mastercard, PayPal, and bank transfers.  
  • Cancellations: Orders may be canceled within 24 hours or before shipment. Contact sales@pratum.co.ke immediately.  
  • Payment Failure: Unpaid orders will be canceled after 48 hours. Suspected fraud will be reported to authorities.  

4. Intellectual Property

  • Ownership: All content (text, logos, images) is owned by Pratum Africa and protected under Kenyan copyright law.  
  • Restrictions: Unauthorized use (e.g., copying product descriptions, replicating designs) is prohibited

5. Limitation of Liability

  • Damages: Pratum Africa is not liable for indirect damages (e.g., lost profits, data loss) from product use or website interruptions.  
  • Cap on Liability: Liability is limited to the total order value or KES [100,000], whichever is lower.  

6. User Accounts and Conduct

  • Security: Users must keep login credentials confidential. Notify us immediately of unauthorized access.  
  • Termination: Accounts may be suspended for breaches (e.g., chargebacks, false information).  

7. Governing Law and Disputes

  • Jurisdiction: Governed by Kenyan law.  
  • Dispute Resolution: Parties agree to mediate disputes in Nairobi before pursuing litigation.  

8. Modifications to Terms

Updates: Pratum Africa may revise these terms. Changes take effect upon posting on the website.  

Notice: Material changes will be emailed to registered users or displayed via website banners.  

9. Severability & Survival

Severability: If any term is deemed invalid by a court, the remaining terms remain fully enforceable.  

  • Survival: Sections on Intellectual Property, Limitation of Liability, and Governing Law survive account termination.
